On 1 August 2025, the European Court of Justice upheld the European Court’s ruling of November 2022 on titanium dioxide, thereby invalidating the classification of titanium dioxide in certain powder forms as a carcinogenic substance.

The ECJ’s press release states the following:

The Court of Justice states that although the Court exceeded the limits of its review, the annulment of the disputed classification and labelling is nevertheless justified. The Court rightly ruled that the RAC had not taken into account all the relevant aspects for the assessment of the scientific study in question.

This judgment is immediately enforceable: the classification is therefore invalid and the previous labelling requirements no longer apply. The entry for titanium dioxide will be deleted from Annex VI to the CLP Regulation (EC) 1272/2008.
